GENERAL TERMS AND CONDITIONS
of the Promotional Campaign „Win with Visa from BACB”

Section 1. Campaign Organizer and Official Rules

The promotional Campaign “Win with Visa from BACB” (the “Campaign“) is organized and conducted by Bulgarian American Credit Bank, address: 2, Slavyanska St, Sofia.

These Official Rules have been prepared and publicly announced as of the starting date of the Campaign and are freely available at the website www.bacb.bg throughout the duration of the Campaign, in accordance with the requirements of the applicable Bulgarian legislation.

The Organizer reserves the right to supplement or amend these Official Rules, as the amendments shall become effective upon their announcement on the website www.bacb.bg.

The Organizer may terminate the Campaign at any time, as well as in the case of force majeure, and/or in case of discovering material abuse and/or violations of these Official Rules. In these cases, no compensation shall be payable to the participants.

In the case of abuse, intentional misconduct and/or violation of the Official Rules by a participant, the Organizer may disqualify the respective participant.

In case of disqualification of a participant, no compensation shall be payable to such participant.

Section 2. Territory of the Campaign

The Campaign is organized and takes place throughout the territory of the Republic of Bulgaria.

Section 3. Period of the Campaign

The Campaign shall commence on 15 July 2022 at 00:00 hours and continue until 23:59:59 on 15 October 2022 г.

Section 4. Eligibility for Participation

New clients of BACB, who open an account and a Visa card in the period of the Campaign, as well as current clients of BACB, using VISA cards to their accounts with BACB, issued prior to the Campaign start, shall be eligible for participation in the Campaign. All payments made with a digitized VISA card issued by BACB will participate in the prize draw.

Section 5. Campaign Mechanism

In order to participate in the Campaign, the participant shall have to make a purchase, using a digitized Visa card, issued by BACB, with a minimum value of BGN 30 in the period of the campaign, commencing on 15 July at 00:00 hours and ending on 15 October at 23:59:59 hours.

There shall be no limitation in the number of the transactions, made using a single card. Each transaction, with the exception of those, within the applicable restrictions, shall be automatically included in the raffle for the cash awards, after the end of the Campaign.

No transactions, such as ATM/POS terminal withdrawals, transactions, involving payments to companies, involved in gambling activities, transactions, such as topping up BACB Pay mobile wallets or mobile wallets of other banks, shall be eligible for participation in the Campaign.

Section 6. Description of the awards

Section 7. Determining the winners

Winners will be drawn randomly from all participants, who have made a payment of at least BGN 230, using a digitized VISA card, issued by BACB within the period of the Campaign and meeting the requirements, set out in Section 5.

The drawing of the winners shall take place in the period 7.11-11.11.2022 in the presence of a Notary Public. The names of the winning participants will be announced on BACB’s website at www.bacb.bg and winners shall also be notified by phone/email. Upon completion of a declaration of consent for processing personal data for the purposes of the Promotional Campaign “Win with Visa from BACB”, cash awards shall be transferred to the card accounts of the winners within 10 days of the confirmation of the validity of the winning payments drawn.

The current account /Card Account/, related to the respective Participating Card, used to make the respective winning payments drawn, shall be active and valid as of the moment of receiving the award. If the account is closed or blocked (inactive), the respective participant shall lose his/her right to receive the award. In this case, the award shall be given to a reserve participant, within 30 days of confirming the validity of the winning payments drawn.

Each and every Winner, natural person, shall declare and pay the income tax due, in accordance with the deadlines and requirements of the Income Taxation of Natural Persons Act („ITNPA“).

Section 8. Liability

The Organizer shall not be liable for any technical issues, when using Participating Cards.

The Organizer shall not be liable (to the extent, permitted by law) for any losses, costs or damages, arising or resulting from the Campaign or the participation by any Participant in the Campaign or if the Campaign does not take place, as planned.

The Organizer shall not be liable for any lack of a POS terminal at physical sites, where payments are made, or if there is a POS terminal, but it cannot process a payment, made, using a Participating Card.

The Organizer shall not be liable for any failure of an online shop to accept card payments or if a Participating Card is not accepted.

Section 9. Personal Data

In order to participate in the promotional Campaign “Win with Visa from BACB” and to receive the respective award, winning participants must provide their consent to the processing of their personal data in the form of a declaration – consent to the processing of Personal Data for the purposes of the “Win with Visa from BACB”. The personal data of persons shall only be processed with respect to their participation in the promotional Campaign “Win with Visa from BACB”.

Information, regarding the processing of Personal Data by BACB AD for the promotional Campaign “Win with Visa from BACB”:

BACB, processes the following Personal Data of the participants in the promotional Campaign: • full name; • address; • contact details – telephone number and email address;

The personal data of the participants shall be processed for the purpose of the registration of the participants in the Promotional Campaign “Win with Visa from BACB”, the identification of the winning participants and for the purpose of the provision of the awards won, as detailed above.

BACB shall process the personal data of the participants in the promotional Campaign “Win with Visa from BACB”, in strict compliance of Regulation (EU) 2016/679 REGULATION (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“Regulation (EU) 2016/679") and the Personal Data Protection Act.

In compliance with the legal requirements, as a Data Controller BACB shall provide the following information, on the way it processes Personal Data to the participants in the promotional campaign:

For the purposes of the promotional Campaign “Win with Visa from BACB”, “Bulgarian American Credit Bank“ AD (BACB AD), registered with the Commercial Register and Register of the Non-Profit Legal Entities, UIC: 121246419, with seat and registered office at: 2, Slavyanska St, 1000 Sofia, shall process Personal Data of the participants in the Campaign.
For any and all matters and issues, related to the processing of their personal data, the participants may contact the Data Protection Officer at BACB AD at the following email address: dpo@bacb.bg; or call (+359) 2 9058 337.
The basis for the processing of the personal data shall be the consent, obtained from the participants, winning the award. The award winners shall give their express consent to the processing of their personal data – full name, telephone number, email and physical address – for the purpose of their identification, as the winning participants and the granting of the award won.
The rights, related to the processing of the personal data by BACB and the actions, which may be undertaken by the persons, whose data are processed, are detailed in the BACB’s Personal Data Protection Policy, accessible at https://www.bacb.bg/bg/pravna-informacija.
The persons may file a request, based on a template, for access to their personal data, signed by a qualified electronic signature, sent to the e-mail address of the data protection officer at BACB: dpo@bacb.bg or to submit a request, based on a template, for access to their personal data, as a hard copy, signed by the data subject, at any of the desks in any of BACB’s offices. Section 10. Information, Regarding the Campaign

Information, regarding the Campaign can be received by request, sent to visapromo@bacb.bg or by calling 0700 14488/*4488 on Working Days, between 9.00 a.m. and 5.00 p.m.

Section 11. Applicable Law

These Official Rules shall be governed and interpreted in accordance with the legislation of the Republic of Bulgaria.

Any possible disputes, regarding the Campaign, arising between Registered Participants /Participating Card Holders and the Organizer /Client shall be settled through negotiations. Should this prove impossible, the relevant dispute shall be referred to the competent courts in the city of Sofia.
